Website Design & Development Services
1. Browser compatibility
Bro Design Studio makes every effort to design and build websites that display correctly in the most popular current browsers at the time of development. Due to the fast‑moving nature of web technology, Bro Design Studio cannot accept responsibility for display issues arising from new browser versions, deprecated features, or third‑party updates released after the website has been completed.
2. Errors, bugs & website behaviour
All websites, scripts, and programs are tested thoroughly during development. Whilst every endeavour is made to ensure the website is free from errors, Bro Design Studio cannot accept responsibility for any losses, issues, or business impacts resulting from website malfunction, downtime, or third‑party service failures or updates.
3. Development process & approval
During development, the client’s website will be placed on a development server for review and feedback. Once both parties agree that the website meets the agreed specification, the site will be published to the chosen hosting environment and the final project invoice will be issued.
Approval of the final build constitutes acceptance of the project scope. Any requests that alter the agreed specification, including design changes, functional changes, additional pages, or revisions beyond the agreed scope, will be treated as out‑of‑scope and may attract additional fees.
Bro Design Studio may retain a development version of the website indefinitely for the purposes of future updates, enhancements, or additional work. This development environment is provided on a private, non‑public URL and is protected behind HTTP authentication. It is intended solely for project review and development use, and is not maintained or updated unless future work is specifically commissioned.
4. Post‑launch support & maintenance
Bro Design Studio does not provide ongoing website maintenance or updates as part of the initial design and development commission. If the client requires ongoing support, updates, or enhancements, Bro Design Studio can provide a separate maintenance contract or undertake work on a time‑and‑materials basis.
5. Guarantee period
Bro Design Studio provides a limited guarantee period of 21 days from the date the website is launched. This guarantee covers genuine technical launch‑related issues that directly relate to the agreed project scope and were not identifiable during the development or QA phase.
The guarantee does not cover:
- New features, enhancements, or refinements requested after launch
- Issues arising from third‑party services, hosting environments, or client‑installed plugins
- Problems caused by code or other changes made by the client or any third party
- Issues resulting from lack of maintenance, outdated software, or security vulnerabilities
- Search engine rankings, SEO performance, traffic levels, or visibility outcomes
Any work requested outside the guarantee period, or any work falling outside the original scope, will be treated as additional billable support.
6. Client responsibilities
The client agrees to provide all necessary content, assets, access credentials, and information required for the project in a timely manner. Delays in providing required materials may extend project timelines.
The client is solely responsible for the legality, accuracy, and compliance of all content provided. Bro Design Studio accepts no liability for any legal issues arising from client‑supplied content.
Bro Design Studio cannot accept responsibility for any issues, errors, or technical problems arising from changes made to the website by the client or any third‑party developer. Any work required to diagnose, repair, or restore functionality after such changes will be treated as additional billable work.
7. Hosting, third‑party services & integrations
Where hosting, plugins, APIs, or third‑party services are used, Bro Design Studio cannot be held liable for outages, changes, or issues caused by external providers. Any work required due to third‑party updates or incompatibilities will be treated as additional billable work.
If the client chooses to self‑host the website on their own server or hosting environment, Bro Design Studio cannot accept responsibility for any issues arising from server configuration, security settings, software versions, performance limitations, or hosting‑related outages or downtime. Any work required to diagnose or resolve problems caused by the client’s hosting environment, including the raising of support tickets, will be treated as additional billable work.
8. Client‑installed plugins
If the client installs additional plugins, extensions, or software after the website has been delivered, Bro Design Studio cannot accept responsibility for any issues arising from those installations. This includes (but is not limited to) security vulnerabilities, performance degradation, conflicts with existing functionality, or website malfunction. Any work required to diagnose or resolve problems caused by client‑installed plugins will be treated as additional billable work.
9. Client maintenance & updates
The ongoing security of the website depends on regular updates to WordPress, plugins, themes, and server environment. If the client chooses not to maintain these updates, Bro Design Studio cannot be held liable for security breaches, malware infections, data loss, or performance issues resulting from outdated software. Any remediation, cleanup, recovery, or repair work required due to lack of maintenance will be treated as additional billable work.
10. SEO disclaimer
If commissioned to do so, Bro Design Studio will implement SEO best practices where agreed, including clean code structure, appropriate metadata, and performance‑focused development. However, Bro Design Studio cannot guarantee specific search engine rankings, traffic levels, enquiries or visibility outcomes. Search engine performance depends on many external factors outside Bro Design Studio’s control, including competition, algorithm changes, content quality, hosting performance, and the client’s ongoing marketing activity. SEO work is an additional, optional, billable service.
11. Payment
Invoices are due according to the payment schedule stated in the proposal unless otherwise agreed in writing. Late payments may result in paused work or delayed delivery.
Website development projects are typically billed in three stages. The timeframe for each stage is outlined in the project proposal and forms part of the agreed schedule.
- Stage 1 – Project deposit
A non‑refundable deposit is required prior to any work commencing. Work will not begin until this payment has been received.
- Stage 2 – Completion of development
Once the website build has been completed and delivered for review on the development server, the Stage 2 invoice becomes due. This payment covers the full development phase. Access to the development site may be paused if payment is not made within the stated terms.
- Stage 3 – Pre‑launch
The final payment is required prior to the website being launched to the live hosting environment. Websites are never launched until full payment has been received.
Where a client chooses not to launch the website immediately, or delays launch for any reason, the Stage 3 payment becomes due no later than 21 days after the date the completed website is delivered for review. If the client delays launch beyond this period, Bro Design Studio reserves the right to invoice and require payment for Stage 3 regardless of launch status. Continued access to the development site may be suspended until payment is received.
No further work, future amendments, or launch‑related tasks will be undertaken until all outstanding invoices have been paid in full.
If the client cancels the project after work has commenced, all completed work will be invoiced at the agreed rate, and the Stage 1 deposit will not be refunded.
12. Intellectual property
Bro Design Studio retains ownership of all website design concepts, development frameworks, source code, and proprietary tools used during the project. Upon full and cleared payment, the client is granted a non‑exclusive licence to use the final website build as delivered. This licence does not transfer ownership of any underlying frameworks, proprietary code, or development tools, which remain the property of Bro Design Studio.
13. GDPR integrations & client responsibility
Bro Design Studio can implement GDPR‑related tools and integrations as part of a website build, including consent banners, cookie‑blocking scripts, privacy notices, and third‑party compliance tools where requested. These integrations are provided on a best‑practice basis and rely on the correct configuration of third‑party services such as analytics platforms, marketing pixels, CRM systems, and consent‑management tools.
Bro Design Studio does not provide legal advice nor can guarantee full GDPR compliance for the client’s business. The client is responsible for ensuring that all data‑collection practices, marketing tools, tracking scripts, and third‑party services used on the website comply with applicable data‑protection laws. The client must also ensure that any content provided for privacy notices, cookie policies, or consent banners is accurate and legally sufficient. Bro Design Studio accepts no liability for GDPR breaches, fines, or compliance failures arising from the client’s data‑handling practices or third‑party tools.
Any changes to GDPR requirements, third‑party tools, or the client’s data‑processing activities may require updates to the website or its integrations. Such updates fall outside the original project scope and will be treated as additional billable work.
